Asbestos Exposure: A Global Problem
Many individuals fall into a common trap of believing that a problem only exists in a small, defined corner of the world. Whether this is due to hearing items on the local news or learning about tragic events anecdotally, it leads to a dramatically limited perspective. A recent report released in the UK shines a shocking light on the worldwide impact of asbestos exposure.
The Institution of Occupational Safety and Health (IOSH) estimates that more than 100,000 people die from asbestos-related diseases around the world every year. They go on to state that about 20 people die in the United Kingdom each week from work-related asbestos exposure. This is far more people than who die from accidents at work over the same period.
The IOSH cautions that asbestos-related diseases could cause 10 million deaths before the situation is fully controlled.
"Latest estimates suggest as many as a quarter of a million lives may be lost every year to the work-related effects of exposure to asbestos," said Dr. Jukka Takala, from the Workplace Safety and Health Institute in Singapore and President of the international Commission on Occupational Health.
Asbestos is a naturally occurring mineral lauded for being resistant to heat transfer. Countless industries from building construction to water-pipe insulation to floor tile manufacturing use asbestos. Over a century ago, however, the material was found to cause asbestosis and various cancers such as mesothelioma. Individuals across the world from auto mechanics to school children are exposed to this danger on a daily basis.

September is Mesothelioma Awareness Month
When asbestos fibers are inhaled or ingested, they penetrate different areas of the body, causing both scaring and genetic damage to cells. Over time, the asbestos fibers disrupt the normal process of cell division and replication and, eventually, can cause cancer. Mesothelioma is an aggressive, incurable form of cancer that is caused by asbestos exposure.
The whole month of September is dedicated as Mesothelioma Awareness Month and September 26 is Mesothelioma Awareness Day.
Below are a list of Mesothelioma Awareness Month events happening around the country that you can participate in to spread awareness and support those with mesothelioma:
9/21: Mesothelioma Warrior Race Dinner in Alton, IL
9/22: Miles for Meso Walk & Run and Virtual Race
9/26: Mesothelioma Awareness Day
9/26: 13th ADAO Congressional Staff Briefing
9/26: Ban Asbestos Petition Delivered to Congress

Auto Mechanics and the Risk of Asbestos Exposure
Hundreds of years ago, asbestos was considered by many to be a gift from nature. It was a naturally occurring material that could insulate products and prevent heat transfer both to adjacent materials as well as human handlers. Starting in the mid-1800s, the material was widely used in industrial compounds and mixtures with products ranging from the consumer market, to building materials, to vehicle parts. Unfortunately, in the early 1900s, it was determined that inhalation of asbestos fibers could lead to lung disease and cancer such as asbestosis and mesothelioma.
While asbestos is not used in new motor vehicle assemblies since 1988, the material can still be found in many replacement parts as well as the original components in use in many older vehicles. Career professional automotive technicians as well as shade-tree do it yourself mechanics are at risk for handling potentially dangerous materials every time they decide to work on a late-model vehicle our purchase replacement parts.
Due to the heat-resistant properties of asbestos, it was a popular material in numerous automotive parts, including:
- Brakes
- Clutches
- Heat seals
- Gaskets
- Hood liners
- Body construction
- Engine components
- Insulation
When asbestos dust from any activity is released into the air, it becomes deadly upon inhalation. Auto parts, such as brake pads, wear when in use or can be arced or sanded when new, leading to the release of easily breathable fibers. It is critical that individuals act quickly to discuss their unique situation with a skilled personal injury attorney who can provide the answers and legal guidance they need.

LA Jury: $8.45 Million Verdict for Pipefitter's Mesothelioma
Our law firm has a strong history of fighting for pipefitters and their loved ones and survivors in the quest for recovery in personal injury and wrongful death lawsuits for injuries from wrongful exposure to asbestos that resulted in mesothelioma and other deadly diseases.
On August 28, a Los Angeles state court jury awarded $8.45 million to a pipefitter's surviving son after the father, Robert Swanson, had been exposed to asbestos in insulation used in his work on boilers. According to The Virginian-Pilot, the jurors found that the company Weil-McLain had contributed to the father's mesothelioma by distributing the dangerous insulation for use with its boilers.
Witnesses reportedly testified that Weil-McLain bought bags of pure asbestos that had warning labels but repackaged the asbestos into plain bags without warning labels for redistribution to customers.
Pipefitter Asbestos Risks
Pipefitters as well as steamfitters, plumbers and boilermakers have historically faced the danger of asbestos exposure through their work with potentially asbestos-containing materials, known as ACMs, like insulation, sheeting, felt, diatomaceous earth, gaskets, packing, cement filler and other ACMs in large-scale settings like industrial sites, commercial buildings, shipyards and more.
Anyone who has worked in these professions suffering from an asbestos-related disease like mesothelioma, asbestosis, lung cancer or another illness should speak with an attorney as soon as possible to understand potential legal remedies. Similarly, survivors of pipefitters who died from these diseases should talk to legal counsel about the possibility of wrongful death suits.
Recovery in these kinds of lawsuits can bring compensation for medical costs, pain and suffering, lost wages, loss of companionship, lost earning capacity and more, and in extreme cases, punitive damages meant to punish wrongdoers.

California Jury Awards Roundup Victim $289 Million in Damages
A San Francisco jury awarded DeWayne Lee Johnson $39 million in compensatory damages and $250 million in punitive damages. Johnson developed lymphoma after years of applying Monsato's Roundup and Ranger Pro products to several school properties in the Bay Area.
Ken Cook, president of the Environmental Working Group, describes Roundup as the "Oxycontin of pesticides" and hopes that the ruling will send a strong message to Monsanto.
Monsanto, which recently merged with Bayer AG, continues to be run independently.
Monsanto's Vice President of Global Strategy, stated that they are sympathetic with Mr. Johnson, but continues to deny the harmful side effects of Roundup's main, carcinogenic ingredient-glyphosate.
Glyphosate in California
Since glyphosate's introduction to the United States as an herbicide, it is estimated that growers have used 1.8 million tons. The bulk of the chemical was sprayed on corn and soy in the Midwest. However, California growers applied it to crops across 4 million acres.
California now considers glyphosate to be dangerous and lists it as a "probable" carcinogen even though the facts are undeniable. The U.S. District Court blocked moves to require the addition of a cancer warning label to products sold in California that contain the chemical even though it was approved by voters under the Safe Drinking Water and Toxic Enforcement Act in 1986.
Because of Mr. Johnson's case, California cities Benicia and Novato, have banned the use of the Roundup.

Asbestos and Other Harmful Substances Found in School Supplies
Recently we posted a blog about the dangers of children being exposed to asbestos in school. Now the threat to students, teachers, and school staff is increased due to asbestos and other harmful substances in school supplies.
Playskool crayons (36 count)
Playskool crayons purchased at Dollar Tree have been found to contain asbestos. If ingested or inhaled, users could be at risk for an asbestos-related illness such as mesothelioma.
EXPO dry erase markers with scented ink
These markers, which were purchased on Amazon, were found to contain benzene, a chemical that has been linked to liver, kidney, and immune system damage.
The Board Dudes six magnetic dry erase markers
Like the EXPO markers, Board Dudes magnetic dry erase markers were also found to contain traces of chemicals known to cause liver, kidney, and immune system damage.
Jot 1-inch 3-ring binder in blue
This binder, sold at Dollar Tree, tested positive for traces of phthalates, a group of chemicals used to soften plastics.
Phthalates can cause problems for children, including issues with development, asthma and childhood obesity.
Be Vigilant
Other products from these brands may also contain dangerous materials. Be cautious of the supplies you purchase your children this school year.
